Terms & Conditions Dygma Ambassadors

Welcome to Dygma! Thanks for joining our Ambassadors program.

As an active affiliate (Affiliate) of Dygma Labs S.L (Dygma Labs), you agree to abide by the terms and conditions contained in this Agreement (Agreement).

Please read it carefully before registering and promoting Dygma Labs as an Affiliate.

Your participation in the Program is purely to promote our products and to receive a commission on products purchased by individuals referred to Dygma Labs by your own website, social channels, links or personal referrals. Please make sure that all referrals come through the links provided containing the correct UTM handle for your program.

By signing up for the Dygma Labs Ambassadors program (Program), you indicate your acceptance of this Agreement and its terms and conditions.

1. Approval or Rejection of the Application

We reserve the right to approve or reject any application to our Ambassadors Program.

2. Duties as an Ambassador

As an Ambassador, you may be asked to fulfil certain duties that will have been stipulated in the conversations between the parties prior to the agreement.

Failure to comply with these duties may lead to downgrading or total freezing of commissions.

3. Commissions

Commissions will be paid monthly (at the end of each month) and the amount will depend on the commission stipulated between the parties, from 2% to 5%. Dygma reserves the right to upgrade or downgrade the percentage of commission that could be perceived by the collaborator.

You cannot refer to yourself, and you will not receive a commission on your own accounts.

There is no limit to the number of orders made by an individual, you will receive commissions based on total order value, and not on the number of orders.

Payments will only be sent for transactions that have been successfully completed. Transactions that result in chargebacks or refunds will not be paid out.

The percentage of commission will be stipulated following one of this conditions:

Depending on the number of followers on, at least, one social channel:

  • 2% from 0 to 100K followers in any social network

  • 3% from 100K to 500K followers in any social network

  • 4% from 500K to 1M followers in any social network

  • 5% from 1M onwards

Depending on their monthly sales:

  • 2% less than 5 sales per month

  • 3% from 5 to 10 sales per month

  • 4% from 10 to 15 sales per month

  • 5% from 15 sales onwards

4. Termination

Your affiliate application and status in the Program may be suspended or terminated for any of the following reasons:

  • Inappropriate advertisements (false claims, misleading hyperlinks, etc.).

  • Spamming (mass email, mass newsgroup posting, post links in discount coupon sites, etc).

  • Advertising on sites containing or promoting illegal activities.

  • Failure to disclose the affiliate relationship for any promotion that qualifies as an endorsement under existing Federal Trade Commission guidelines and regulations, or any applicable state laws.

  • Violation of intellectual property rights. Dygma Labs reserves the right to require license agreements from those who employ trademarks of Dygma Labs in order to protect our intellectual property rights.

  • Self-referrals, fraudulent transactions, suspected Affiliate fraud.

  • Promoting or engaging in hate speech or discriminatory language of any kind.

  • Promoting or engaging in any violent conduct towards a particular person or a group as a whole.

In addition to the above, Dygma Labs reserves the right to terminate any Affiliate account at any time, for any violations of this Agreement.

5. Affiliate Links

You may use graphic and text links both on your website and within your email messages. You may also advertise the Dygma Labs site online.

You may use the graphics and text provided by us, or you may create your own as long as they are deemed appropriate according to the conditions and not in violation of Dygma’s brand guidelines.

6. Coupon and Deal Sites

Dygma Labs occasionally offers coupons to select Affiliates and to our newsletter subscribers. If you’re not pre-approved / assigned a branded coupon, then you’re not allowed to promote the coupon. Below are the terms that apply for any affiliate who is considering the promotion of our products in relation to a deal or coupon:

Affiliates may not use misleading text on affiliate links, buttons or images to imply anything besides currently authorized deals to the specific affiliate.

Users must be able to see coupon/deal/savings information and details before an affiliate cookie is set (i.e. “click here to see coupons and open a window to merchant site” is NOT allowed).

Affiliate sites may not have “Click for (or to see) Deal/Coupon” or any variation, when there are no coupons or deals available, and the click opens the merchant site or sets a cookie. Affiliates with such text on the merchant landing page will be removed from the program immediately.

7. Term of the Agreement

The term of this Agreement begins when you sign up as an Affiliate using the Shopify Collabs registration form or when we approve your petition from our website form.

The terms and conditions of this agreement may be modified by us at any time. If any modification to the terms and conditions of this Agreement is unacceptable to you, you may contact us to request a modification, though Dygma Labs reserves the right to decline this request.

8. Governing Law

This Agreement shall be governed by the rules and procedures of Spanish regulation, without regard to its conflict of laws or rules.

9. Agreement and account creation

The Agreement is an electronic contract that sets out the legally binding terms of your participation in the Dygma Labs Ambassadors program. You indicate your acceptance of this Agreement and all of the terms and conditions contained or referenced in this Agreement by completing the Shopify Collabs and/or Dygma Labs application process. Completing the Shopify Collabs registration and creating an account will be deemed as an electronic signature that has the same legal force and effect as a handwritten signature.
